Free Annual Credit Reports

Lawyers.comsm

Under the Fair and Accurate Credit Transactions Act (FACTA), an amendment to the Fair Credit Reporting Act, all consumers are entitled to a free annual credit report, upon request, from each of the three major consumer reporting agencies (CRAs)--Equifax, Experian, and Trans Union. These three companies collect credit-related information on consumers and provide it to other authorized parties seeking credit references.

Obtaining Free Annual Credit Reports

Consumers may obtain a free annual credit report by contacting the three major CRAs:

Equifax
800-685-1111

Experian
888-397-3742

Trans Union

FACTA Requirements

In accordance with FACTA, the Federal Trade Commission issued a final rule regarding the free annual credit report requirement. The rule requires the CRAs to establish a "centralized source" for accepting consumer requests for free credit reports. The centralized source must include a dedicated Internet Web site, a toll-free telephone number, and a postal address. In addition, the centralized source:

  • Must have adequate capacity to accept requests from the reasonably anticipated volume of consumers making requests
  • May collect only as much personally identifiable information as is necessary to process requests
  • Must provide clear and easily understandable information and instructions on how to make requests and
  • May not include any advertising or marketing that interferes with, detracts from, or undermines the purpose of the centralized source
